In their quest for well-being, patients turn to specialists in the health field. These include the doctor, who is consulted first and prescribes medicines; the pharmacist, who dispenses medicines; and the nurse, who administers medicines. Since the pharmacist is one of the players in this circuit, the question arises as to whether, under Congolese law, the pharmacist can be held liable for damages incurred when dispensing medication in compliance with a medical prescription. In order to answer this question, our analysis focuses firstly on the conditions under which pharmacists are liable under Congolese law, and secondly on the implementation of pharmacists' liability under Congolese law. It appears that the pharmacist's liability is less effective before the courts of Bukavu, for reasons that victims always have the idea that responsibility lies with the prescriber of the medical prescription. Unfortunately, even the prescribing doctor's responsibility is not as effective...
