Sur la toile de fond de la réforme de l'arbitrage d'investissement où il est envisagé de créer une cour multilatérale permanente, la conférence s'interroge sur les notions d'indépendance et d'impartialité, garanties fondamentales de toute justice. Elle compare l'arbitre et le juge et constate que l'impartialité de l'un et de l'autre ne se distingue guère. En revanche, elle identifie des différences quant aux risques qu'encourt l'indépendance dans l'un et l''autre système. Dans un tribunal permanent, l'indépendance structurelle ou institutionnelle est plus vulnérable, alors qu'en arbitrage la composante la plus menacée est l'indépendance individuelle ou personnelle. Sur la base de ces observations, la conférence propose des solutions que les acteurs en présence, principalement les Etats, pourraient mettre en oeuvre pour mieux garantir l'indépendance dans les deux modes de règlement des différends.

Whatever may have been the situation in 1992 when the Rio Conference on Environment and Development convened ('UNCED'), international environmental law certainly exists today, if by that we mean a system of rules and principles regulating global, regional and transboundary environmental problems. It is not a system primarily based on state responsibility for transboundary harm, as conceived for example by Professor Brownlie, but a system designed to facilitate international regulation and management of environmental problems which are of concern to the international community of states represented in the UN system. The Objective of these lectures is to explore and understand how today's system of international environmental law ('IEL') has come into being and how it is made and develops.

Le cours suivant attire l'attention sur les nouveaux défis méthodologiques posés par un monde de plus en plus globalisé et ce, dans la mesure où dans les sociétés modernes, les intérêts individuels deviennent de plus en plus importants. Pour faire face à ces évolutions de notre temps, le droit international privé doit trouver un équilibre entre les intérêts des individus et ceux des États, tout en assurant une cohérence internationale (Savigny: harmonie et uniformité des solutions ).
Ce cours spécial de droit international privé vise à montrer que ces défis peuvent toutefois être relevés, si le système de conflits de lois avec sa méthode de désignation est complété par deux autres méthodes: la méthode de reconnaissance et la méthode de prise en considération.
Ainsi, avec cette méthode tripartite , le droit international privé est suffisamment flexible pour faire face aux évolutions du XXIème siècle.

L'arbitrage est un corps vivant qui vit et mute dans un dialogue permanent avec la société qui l'entoure. Le cours d'Alexis Mourre se propose d'étudier les champs historiques, politiques et linguistiques dans lesquels s'inscrivent les rapports de pouvoir qui le constituent comme institution, et qui sous-tendent les processus qui conduisent à la légitimer ou à la délégitimer. Ces processus s'inscrivent dans une dialectique entre élaboration de représentations qui sont autant de discours de légitimation et réception de ces discours par la société. Fondé sur le pouvoir créateur de l'autonomie individuelle, que l'on ne saurait détacher du droit naturel, l'arbitrage s'est développé à l'époque moderne comme système de justice du commerce international, dont la légitimé fonctionnelle et institutionnelle repose sur la capacité des représentations qu'il produit à répondre à des valeurs permettant à la société de voir en lui une institution utile à l'intérêt général. La mesure dans laquelle l'arbitrage est ainsi capable de produire des discours lui permettant de se mettre en adéquation avec ces valeurs donne la mesure de la légitimité à laquelle il peut aspirer.
