Esta antologÃa de comprende Todas las Constituciones cubanas. Desde las primeras constituciones con que las fuerzas independentistas conformaron un código legal y un marco de actuación jurÃdico desde el que legitimar sus posiciones. Las tres primeras de estas constituciones, aquà incluidas, se ocupan de preparar un espacio de poder y legalidad. Se pretende con ellas, entre otros asuntos, establecer tratados y separar el poder judicial del resto de los poderes.
Es a partir de la Constitución de la Yaya que los escritos constitucionales de los movimientos independendistas cubanos empiezan a establecer auténticos principios de gobernabilidad. En una creciente voluntad de abarcar los aspectos polÃticos más cercanos a la vida cotidiana en la isla. Y también con la pretensión de diálogo con las dos fuerzas extranjeras que más incidieron en la Cuba de entonces: España y los Estados Unidos.
Este libro incluye, entre otras, la Constitución autonómica de 1897.
Aparece aquà también la Enmienda Platt, redactada por los americanos durante su protectorado, debido al peso que tuvo en la historia de Cuba.
En la Constitución cubana de 1940 las razas, la emigración, la condición de la mujer, la igualdad de posibilidades y la defensa de un Estado protector de las clases desfavorecidas son elementos de referencia.
Aunque la posterior historia polÃtica de Cuba restringió ese texto con sucesivas enmiendas hasta anularlo por completo, sustituyéndolo por la Constitución de 1976. Resulta irónico que participasen en su redacción los comunistas cubanas, las mismas fuerzas polÃticas que después la desvirtuaron.
Las constituciones comunistas de 1976 y 1992 hacen énfasis en las definiciones ideológicas de la revolución cubana por encima de las libertades individuales. Asimismo en estas dos constituciones se insiste más en la permanencia de una epopeya épica y transhistórica que abarca a todos los sectores de la sociedad cubana, en detrimento de la gestión práctica de la misma.
